Hello Guys,
I lost my job last week and we have decided to return back to India.
Filed 2 times for GC and got stalled for some reason or another. I am on my 7th year extension. We decided to go back due to frustrtion of Immi. policies and other personel reasons.
I was one of the first 500 members in immigrationvoice.com.(but was not so actively involved)
Still remember those days in 2005, I was an active member of another website callled us immigration america travel news at isnamerica.org (http://www.isnamerica.org). (new members might not know abt this site)
I was very critical of IV during it was formed, but became a member after I got a call from one of the founders of IV.(dont remember who?)

Just mark NO, since it is a Yes / No question. You currently have EAD for next 2 years, hopefully it'll get renewed. You don't have a crystal ball to tell what will happen after that.
So you are not mis-representing by saying NO.

As per INA Sec 101(b), the definition of child is dependent who is unmarried and under 21 years old. The Child Status Protection Act (2002) provides some additional relief. This article could be useful for you -

Hi !
My husband just had his performance appraisal today. He is presently working as a Senior Consultant.What we are wondering is that if there is any change in the designation, will it affect the GC process in any way ?
We got our I-140 last month and EAD two weeks back.
Kindly advice us on this.

Until its the same kind of work, it wont effect the GC process. Your employer could send an ammendment saying that theres an appraisal.

My wife had the same situation - was going to be out of town on the scheduled day. She went to the Dallas office on a Wednesday or Thursday and explained the situation to them. They said they were busy that day and said she had upto 89 (?) days to do it. They said she could walk in on any Saturday within that time frame. They also said that there was no need to reschedule. Sure enough, she went in on a Saturday 2 or 3 weeks after the scheduled date and they took her fingerprints.

Currently i have my I-140 approved an that is all i know. To be honest, PD to me means "the day my I-140 was approved". Is that true??
My wife lives with me on H-4 and she will hopefully get an ITIN this year. Now, how i understand the system, i cannot file for I-485 petition until, the date of my I-140 approval becomes current. Please verify to help me understand this system. Thanks in advance.
PD = Priority date. That is the date that gets assigned to your case which is the date your labor/perm was filed or the date you directly filed I-140 if no Labor/Perm was required. You can only file your 485 once the visa date in the visa bulletin for your EB category is either current, matches your PD month or is a date later than your PD date.
One you file for 485, you can avail benefits like EAD a.k.a workpermit for you and your wife who can choose to use the work permit to avail any job. There can be an argument made that still keep working on your H1, but EAD helps spouses work legally who are otherwise on H4 and are not allowed to work.
Again check with an attorney for legal advice, this is just a nutshell of the process. Hope it helps

i enetered US on h4 visa in sept. 2007. got h1b and started working on h1 in october 2008. was laid off in nov 2009 and my husband promptly filed my h4 and got approval in march this year. now another employer has filed for my h1b visa. do I need to wait for h1b approval notice since I am on h4 visa or can I start working as soon as the company receives the receipt notice?thanks for your answers.

Is it possible to ship the two I-485 pakcages to INS?
My labor and 140 already approved. My law firm preparing I-485 to submit through same day service.
In case if they are not able to do it within the time, I want to submit I-485 on Monday through same day service without telling to the law firm.
This causes duplicate submission. Can I or law firm subsequently with draw one of the I-485 later?
Please advise. Urgent. Appreciate your help.

No, CIS local offices don't do this. There is no mistake on the I-94, so the only way to change it is as described in the prior answer.

I want to transfer from H1B to F1.I came to US as a F1 and graduated in march 08.I got my H1B on oct 08.But now i want to transfer to F1 again and i had my visa till 2011. I had following doubts and please help me.
1) I heard that i can transfer to F1 from H1B without canceling(but deactivating H1B) is it true.
2) How much time does it take if i apply for change of status for F1?
3)can i take cpt in F1 and later on can i change to H1 by applying change of status?

You got your H1B in Oct 2008. That means your status changed from F1 to H1. Now its March 2009. So all these period are you employed and have the pay stubs for the same. If you dont have then you are out of status and you can not change the status to F1. If you want to change the status, you need to be in status first.

My friend came to US on January through one bodyshopper on H1B visa and he was on project for 4 months.When his project is over and he is on bench then his employer forcing him to send him a email stating that he will be on leave without pay and immediately his employer stopped paying him salary from the day he was on bench.
Can any one please guide me that how to file complaint to DOL against his body shopper.
Also i wanted to know that will DOL take any against his body shopper and what information DOL will ask as currently my friend does not wanted to confront with his employer.

I filed 140 and 485 concurrently (July, 2007). Today I received an email update saying that a RFE has been sent about my 485 petition. There's a LUD update for my 485 but my 140 seems untouched. What kind of issues with the case would prompt an RFE for the 485 before the 140 is processed? Is this for a second set of fingerprints or could this be something more serious? Thanks in advance for your responses.
Any issue with Birth Certificate, Marriage Certificate (if you are a dependent), Medical report & etc could trigger an RFE.
May be your 140 is approvable & 485 will be approved as soon as you reply to the RFE.
I have seen other posts in this forum where people have reported that they received both 485 and 140 approvals together.
Whatever the RFE is, reply to it ASAP and you should be lucky enough to get your GC before the dates change.

You can call USCIS if you don't hear from them within 90 days of filing EAD. Many of you probably know this already, but I thought that was interesting... and may benefit those who didn't know this already.
