I have 140 approval notice in mail like 1.5yrs back...just today i put the reciept number on USCIS website and it says still pending..i called USCIS and they say they wont be able to discuss my case since 140 is employer specific only....my employer is sayin dont worry and dont bother about online status...i just want to make sure my 140 is really approved and USCIS has the correct update while lookin at my 485 file...i dont want them to put my 485 in hold just because of they thinkin 140 is not approved...

As long as you have approval copy on hand, you have nothing to worry. You should be concerned only if the status reads as 'case reopened and pending'

Does anybody have any experience using this camera in the studio? If so, what lighting equipment are you using. The manual only says to use Canon flashes or equivalent, which aren't going to cut it. I'm not that familiar with trigger voltage (250V) and don't want to fry the thing. Any responses would be greatly appreciated. What I'm looking for is a brand of lights that would work with E-TTL. Thanks

Does it mean that if she graduates before the I-485 is approved, she cannot work? Or can she accept employment on the green card EAD even though the I-140/I-485 are pending. What will be her status during that period?

My lawyer is saying whatever exp. you will give, you should have originals of that. I don't have much hold of my lawyer and he is not suggesting whether I should use new experience than what I used in my first labor.
Thats why I want to know if anybody else has done this before..

As long as you haven't used the EAD/AP for employment purposes, I think your H1 is still valid. If your H1 is still valid then I believe you can get your denpendant's H-4 extended based on our H1 validitiy. But I suggest to contact your company attorney to make sure your H1 is still valid.

Your Priority date seems to be Dec 2005 and if i remember correctly USCIS had a memo to complete all Background Check in 6 Months so yours should have been over long time ago.
But Again I am not a expert here and could be wrong, EXPERTS please advise

Just ensure that they will be able to document enough ties back home for officer to feel comfortable that they would return. From your side, provide evidence that you can afford their stay. Barring that, I see no reason why going separately or together would make a difference.
Perhaps, the only way to tell is yo try it.

Hi- My stamping on my passport expired on Sep'2008 (over 19 months now). But, my I-797 is valid till Aug'2012. I plan to get my visa re-stamping done when I go to India in May'10.
1. Will there be any issues?
2. What am I supposed to say for this question in the visa application website?
"Are you applying for the same class of visa which is currently valid or has expired within the past 12 months?*" (YES/NO)
The VFS website says the following:
"The following applicants do NOT qualify for appointments in the visa renewal category:
Applicants who have a U.S. visa that expired more than 12 months ago.

As for as the standard procedures concerned, you will have no issues. There are chances for 221g, definitely not because of you have let the visa stamp expired, but if they need to check about your company.
2. You should choose "NO". You have crossed the timeline for a visa renewal queue and it is considered as a new h1 stamp. Keep in mind that this is just a queue, who gets appointments before you + can stand in front of you. As soon as you reach the counter, the procedures of how your request is validated by the visa officer is same as every other H1.

Dear Friends,
I have changed my employer after 180 days of my pending I-485. I have not communicated USCIS about this. I was able to renew my EAD, and AP online with proper documentation without any issues.
I am planning to travel to India on Advance Parole now. Wondering if I can show my former employer's documentation such as I-485, I-140 approvals if anything arises while going or returning. Do you anticipate any issues with this? or do I need to carry any information about current employer, and my Job?. Appreciate your help.

2. If the I-94 is valid till 11/9/2009 - Nov 9, 2009, If this I-94 is from the previous employer that already has revoked the H1b, it literally does not have any meaning as you are not maintaining your H1b with that employer or working for them.

Your questions are valid....but either way, you must enter US ASAP on your AP (or have someone mail ytou your GC). The issue is that you are NOT totally free once you get GC because immediately leaving your sponsoring employer is a no-no and can cause your GC to be revoked or be an issue at the time of citizenship. It is advisable to stick to the employer for 6mts to 1 year after GC - if the employer is still functioning. Also, USCIS has increased employment place visits for recent GC approvals. :)

I have a master's degree from a top US university but my current employer applied my GC in the EB3 category. I am planning to move to a different company which is willing to apply in the EB2 category. I have an approved 1-140 with the current employer and my I-485 was sent in July/August. Here are the steps I think I should take after moving to the new company:
1) After I move to the new company, I can send AC-21 and continue my GC in the Eb3 category.
2) File a new LC. Send new I-140 in EB2 asking them to use the old PD from the approved EB3 category.
My question is
1) Will I run into any issues for my EB3 because the new I-140 is in EB2? I dont want to jeopardise my EB3 application.
2) Should I not send AC21 if I am planning to switch to EB2 category. My current employer does not revoke I140 even after I move to the new company (anyway, I am doing this after 180 days of I-485).
Any input is appreciated.

I have recently applied for Canadian visa , using my AP at LA , using all original documents in person. You can add all your family members in the same application. I used two different applications , but, they asked me to add all the family members in the same application. They will issue visa till your AP validity. Good Luck.

my experience with O visa is that paperwork, presentation, previous track record of the lawyer with USCIS is critical
so in this case, absorbing the 5000 cost difference may be a good idea
Of course you can always ask your employer if they are willing to take that hit but as you know you have a 50 % chance there at the best
So decision is yours

Its a good consolidated report, It clearly says system is broken and need a fix. Almost all the legislation listed at the end talk about either recapturing lost visas or increase the numerical limit.

That's why the only bills covered at the end of the report are all legalization bills. She seems to have "extensive" analysis on per-country limits on EB &FB, but doesn't have the ink to write 1 line about country limits on the undocumented. The report systematically and intentinally overlooks all other bills that are related to legal immigration only. Most of the time, its not what is written, but who wrote it and how the information is presented which matters.
