    my only problem is Work contracts.

    How am I supposed to get contracts of all clients.
    My employer doesnt share saying its private and confidential..I worked for a top 5 Indian IT in the past..no way I can get those details..duh :confused:

    You need not provide the contracts. Only they need to know is name of the employer. If you talk about the Contracts they can question you about the premises of the permanent job being offered by GC company. If this contracts were needed they should have asked at the I-140 level. May be when you respond you need to tell them I am not working based upon the contracts and I am an employee of the company.

    It appears that some of us are mad at our employers and there can be several reasons –
     We think we are “high-skilled” and deserve more even though we are spending most of our time at work on IV forums
     We think our employer is taking advantage of our situation and if we had green cards we would have taken over the crown from Bill Gates and Warren Buffet
     And so on….

    For some of these reason, we are faulting everybody around us, our employer, companies not our employers, consulting companies/body shopper, other H-1B applicants, L-1 applicants, people who come on B-1, companies like TCS/INFY/SIFY etc. And there seem to be this idea that if a bill is passed to harm consulting companies or body shoppers or companies like TCS/INFY/SIFY, then somehow that is my gain because I am suffering because of these guys. Consistently, I have seen this argument on the forums, but somehow I am not convinced that these guys have to lose something before I could get what I want.

    IEEE-USA, Ron Hira et al has problems with us if educated/skilled/talented people come here on H-1/L-1. So that’s why they oppose any increase in H-1. These guys have a problem with us if we apply for green card and that is why they did not include a single provision in Durbin-Grassley bill to fix the green card backlogs. In fact they are making sure that people waiting for green card will have to somehow leave the country. These same guys at IEEE-USA have a problem if we choose to go back to wherever we came from and we decide not apply for green cards. In this scenario they say that we are promoting outsourcing because we are returning to the country we came from. And if we never ever chose to come here at all, these guys simple say that we are still taking their jobs because we are the people on the receiving end of the outsourcing. So either way you look at it, these guys are simply out there to screw us. The bad thing is they are organized and we are not. And the worst thing is we have guys like Senthil1 on this forum who thinks that by some how causing harm to consulting companies/body shopper/companies like tcs, infy etc we are making up for our delays in the green cards. And I just find this argument very very bizarre. No offense to anyone, but just wanted to clearly say that Durbin-Grassley bill is not designed or intended to help anybody on H-1/L-1/green card applicant, directly and indirectly. In fact, in the long term, I do not know who is getting the benefit from Durbin-Grassley bill other than the BPO companies in the other countries.

    can u pls clarify when u find some time..

    from what I understand and you posted, he changed employers from A to B to C.
    He reentered the US with a visa stamping of AorB and din't get a new H1 visa stamping with C..is that so..?

    but until now 99% of us, are in the same thinking that as long as you have a valid stamping in the passport u r good for rentry..

    so they dig and dig into our passports .. ? we ourselves get dizzy looking into all the pages of our passports.

    Like UN said..wonder what we/they achieve with lawsuits,but we can expect a lot of digging into our cases during AOS...

    (lawsuiting/challenging is no good idea with USCIS/DOS,they will not budge even a mm,they r huge monster govt organizations,it is best to move with the flow and instead work on ideas of allowing to file 485 when dates r not current etc..)

    Good points, but let me put a counter argument. Two people , one is named SunnySurya and the other is named Mr XYZ. Both came to the USA at the same time in 1999. The difference was SunnySurya came here for his masters and the other guy came here through shady means.

    Mr XYZ was able to file his green card in 2002 in EB3 category based on his shady arrangements with his employer, whereas Mr SunnySurya continued to do right and socially acceptable things i.e. studied, got a job and then after several years this big company filled his green card in EB2 category in 2006.

    On the other hand after strugling for several years Mr. XYZ has collected enough years on his resume to be elligible for EB2. Now he want to port his PD

    SunnySurya's PD is 2006 and Mr. XYZ PD is 2002. Now if Mr. XYZ want to stand in EB2 line, I wonder what problems SunnySurya can have???:confused:


    Oh my gosh..This much argument. I do not know the PD porting is law or rule. If it is law, one can not file suit against the amended law. But one can request the law maker to change. If it is a rule, one may do that. But it does not have any merit. It is waste of time.

    PD porting, in theory, is very genuine. (may be not-genuine in many cases; just to cut-short the line or line jump by creating a EB2 job) So, one cannot challagne that. Here is why. A cook may have a PD 2001 in EB3. He has right to study PhD and apply in EB1 catagory, by poring PD. There is no violation of ehics here.

    But there really isn't co-relation between illegal migration and housing crash.. if anything, migrants are also first time buyers and they support prices towards to lower end market and stop entire lower-middle class neighbourhoods from becoming what Detroit or Youngstown have become..

    o.k. ..I had copied comments from other readers and I have removed the unnecessary remarks ..The only reason I am keeping the remaining portion is to show how many of the first time buyers (I guess Americans) feel. so if lot of people think like the above then housing will take longer to stabilize. (BTW I agree there is no relation between immi and housing crash - nor is it implied in the comments I had pasted). I guess sometimes it makes sense to read what other readers / natives feel about certain situations. a final thought (unless I have to respond to someone else's post) - everywhere I look (articles and in real life) - things are real bad in terms of real estate. will things improve - definitely but it may take long time for things to stabilize and hence it makes sense to do extra research before taking a plunge. for e.g at present I am staying in a rented town home - and I got the deal for $850 - the town homes are inside an apt complex in a good neighborhood. (you need to show income of atleast 3 times the rent to get a place here and many tenants are high tech guys). the same town home during boom time had rent of $1250 ..in other words - there are tons of deals due to excessive supply everywhere. one other important point was made by another person - this winter was harsh and hence people did everything to keep a roof above their head - wait till summer and you will see people literally walking away from their homes ...when u read posts like the above ..it makes sense to wait for some more time esp on H1 / EAD.

    Hi,
    I applied for GC under schedule A in may06 .My husband filed as derivative.He received a notice of intent to denial last month .Reason being he did not have paystubs for a period of more than 6 months during 2000 and 2001.His employer at that time did not pay him even after he worked for 4 months then he took few more months to change his company(more than 180 days)In 2002 he went to India and came back .and in 2004 filed for a GC as primary petitioner and me as a derivative .last year he withdrew the petition after he received several RFE`S fearing the worst.Even though he no longer has GC filed as primary petitioner he received notice of intent to deny for the petion filed through me saying that his H1 was not legal as could`nt show proof for several months and that when he filed for AOS he used those years as work experience.
    and now another problem is I applied for EAD in march and have not received new ead.my old ead expired 10 days ago.and now Iam not working.
    We bought a house last year thinking that under schedule A we`ll get GC in no time.Now we know it is a terrible mistake.Now both of us can`t work and had to take my son out of daycare. and we have house payments to make.We put our house for sale weeks ago and so far no offers.I contacted local representative to expedite My EAD and also contacted USCIS to expedite it,
    citing financial burden.We are spending sleepless nights and have no clue what to do for my EAD and his AOS.pLEASE HELP.
    Did anyone face similar situation .Any suggestions are welcome.

    1. When you filed I-485, you should file under 245(K) immediately - I believe someone already mentioned that below. For derivative applications, the derivative applicant may be "out of status" for any length without any issues for AOS approval.

    2. For the 6 mos period he was without pay check, does he have any proof of employment and correspondingly any letter showing that he was on vacation/leave of absense. I had a 15 day period between 2 jobs where I took time off but had no vacation, hence leave without pay but I have leave letter from my manager in letter-head (I know a lot of people do that as taking vacation between jobs gives them a fresh start).

    3. Did the period length where he did not have a pay check exceed 180 days at a stretch?

    Bottomline, it seems an overzealous USCIS officer is trying to find ways to deny your application - you should involve a good lawyer and get immediate rebuttal for Notice of Denial.

    Well, remove the threat by telling Clearly and unmistakably that use of nuclear weapon by Pakistan would invite catastrophic counter attack. Not by using it. Remember, India has "no first use" policy....


    Otherwise what happens...Pak would keep taunting that " Hey, remember we have nukes...wanna pick a fight with us?" and keep doing what they are doing. They are trying to take the option of war OFF the table. India should keep it in the table but use very very cautiously.

    I agree with most of what you said. I just think that the expectation to shed the inertia built over two to three decades is a bit too much. It is going to take time, regardless of what anyone wants. Ironically, hostile relationships between India and Pakistan are only going to prolong the process.

    I disagree, this is not the hostile relationship between two countries, we see this as one country and the international community applying pressure on Pakistan. Without this pressure, there is no way Pakistan will gather the "motivation" to dismantle the terror network. The terror network will get dismantled only if there are two choices, either Pakistan dismantles the terror network or we will dismantle it for Pakistan. Without a direct approach, nothing will change.

    On a different note, there is only one outcome of over analysis by computer analyst or business application analyst, and that outcome is -war is too "expensive". What about the lives of those 200 people who were killed? Please don't expense those 200 lives and other 100,000 lives in last 10 years by your "over analytical" computer analyst Mircosoft projects approach calculating the "cost of the war". What if it is your father who is targated by the terrorist next, I want to know who all will still run the profit and loss statement if your father is killed by the next strike by the terrorist. Will you only agree to a war when your own family member is killed? Don't you think its time to put the bleeding innocent people ahead of this "over analysis".

    We are peace loving people. But should we not respond to the war we did not start. We are not the aggressor, we are the victim here for christ sake.

    Wars are decided by brave men, wars are faught by warriors, and wars are won by patriots. Over analysis at the time of war is a sign of weakness - message of Gita. I hope we agree that War is not like a lala shop to prepare a profit & loss statement before making a decision. We did not start this war, it is being forced on us. The question is - should we respond to the war that is forced on us, the war we did not start, but the war which we have the strength to end.

    Sen. Harry Reid settles into the chair by the fire in his majority leader's office that is so stately and grand it looks like something Las Vegas would create if ever a faux Washington were added to the Strip.

    The first snow of the season has fallen outside his second-floor window, the Washington Monument framed by the sill. He sits close to the fireplace because his neck is stiff from doing his morning push-ups too quickly. Reid still does 120 push-ups and 200 sit-ups each day, but he has condensed his yoga into fewer sessions because there just isn't time. Now, a few days after his 68th birthday, the wear of the job has settled into normalcy.

    It's been a long year of long days and nights here, the first time Democrats have been in charge of Congress in 12 years.

    On this day alone he hosted a breakfast for a Henderson Democrat running for Congress, met with the White House over the budget stalemate, welcomed a group of Nevada real estate officials concerned about the mortgage crisis - and ran the floor of the U.S. Senate.

    Moving to the majority leader's job this year, after all those years as a leader of the minority, has been "the difference between playing first base for the Yankees and playing it for Basic High School."

    Democrats are ending this year downtrodden after the high of sweeping into power following the 2006 election. Congressional approval ratings are at historic lows - lower than those of the unpopular president. Though many of their campaign promises became law, much more of the Democratic agenda remains unfulfilled.

    Reid repeatedly says he feels good about the work he's done this year. Running the Senate, he says, is not as enjoyable as watching the grandkids play ball, but "it's been a tremendously fascinating, interesting year for me."

    Days after the interview in his office, however, he would concede that "I share the frustration" of having Democratic priorities blocked.

    Nevada's first majority leader was barely that, with the Senate thinly divided 51-49. Democrats may have come to Washington believing they had a voter mandate for a new direction, but Republicans had a different opinion. With such a slight majority, Reid's chamber became the place where so much of the Democratic agenda came to die.

    The leader on the House side, Speaker Nancy Pelosi, began 2007 with a bold 100-hours agenda, crafted without Reid's knowledge or input. Democrats should have known that nothing passes that quickly in the slower-moving Senate. Any momentum gained by the legislative flurry would soon be lost.

    Indeed, the bills arrived in the Senate with a thud.

    Senate Republicans soon gave Reid a taste of the partisanship he had dished out in the past and blocked every move. Grand plans for a new energy policy, for example, became skeletons of their original intent. More filibusters were conducted this year than ever in Senate history.

    President Bush, whose own ratings reached all-time lows, asserted himself in a way unexpected for an executive with so little clout and whose party was out of power. His willingness to wield the veto pen for the first time in his presidency created an incentive and a safety net for Republicans to obstruct the Democratic agenda.

    Reid calls Bush the "most stubborn" official he has ever known.

    In this environment, the year became one when politics, not policy, seemed to matter most.

    Both sides appeared to abandon any attempt at forming consensus and concentrated on laying a foundation for the 2008 elections. Democrats will say they need to win more Senate seats to accomplish their goals; Republicans will say voters should be wary of Democrats running Washington.

    Could a leader other than Reid have achieved a better outcome? Why was he unable or unwilling to get Republicans on board? When he couldn't break through the partisan gridlock, should he have tried to be nicer - or meaner?

    Thomas E. Mann, a constitutional scholar at the Brookings Institution, was among those reluctant to grade Reid on this year alone. Wait and see how Reid performs in coming years, especially with a new president, Mann said.

    "I would say incomplete," he said of this year's performance. "The test of Harry Reid's leadership lies ahead."

    What he brings to the job

    Late one night in the Senate this fall, Reid is about to announce that an agreement has been reached to move forward on the Farm Bill after weeks of legislative gridlock. Into the chamber walks a farm state Democrat, Sen. Blanche Lincoln of Arkansas. He pulls her aside. The two stand face to face. One of his hands is on her left shoulder, the other is on her right. She nods, telling him thank you.

    That kind of personal interaction with every member of his caucus is what Democratic senators love most about Reid.

    He is clearly not the most charismatic public face for the party. His first impression on many voters came election night, when the diminutive Reid rambled a soft-spoken speech onstage at the Democrats' victory party.

    Rush Limbaugh dismisses him as "Dingy Harry." When Reid's whispery voice breaks through, it's often spitting an arrow that gets him into trouble - calling Bush a "loser" and a "liar," saying the Iraq war "is lost," deriding Republican senators as "puppets" of the White House.

    As majority leader, future president Lyndon Johnson towered over his colleagues, physically and emotionally, finding their vulnerable buttons and pushing hard, historians tell us. But as majority leader Reid more resembles Mike Mansfield or Bob Dole, a senator among senators - even if, as Democratic Sen. Chuck Schumer wrote in his book, the former boxer will kneecap anyone who crosses him.

    Massachusetts Democratic Sen. Edward Kennedy explained that at the regular Tuesday policy luncheons, when Reid lays out the week's goals for Democratic senators, "people fall in line and support them, because he has done a lot of work prior to that time in listening and giving people an opportunity to be heard."

    Kennedy says Reid builds consensus better "than any leader that I can remember in my time."

    But even this party unity was no match for the Republicans in the Senate who held together just as tightly, refusing to cave to the Democratic agenda.

    Republican Sen. Mel Martinez, the former Republican National Committee chairman who crossed the aisle to try to broker an immigration deal this year, said Reid simply doesn't have enough votes to steamroll the minority.

    "We have 49 - if we were a minority of 39 you could do that," Martinez said. "At some point it's going to have to dawn on him that Americans are going to want to see things getting done."

    Martinez says Reid is more intent on protecting his members from difficult votes than giving Republicans a chance to shape legislation that could pass.

    Only in the final weeks of the session did the backlog of bills pass, as Democrats faced the prospect of ending their first year in legislative gridlock. Everything that arrived on the president's desk was a compromise - energy policy, domestic spending, funding for the Iraq war.

    "The way you accomplish things in the Senate is in the middle," said the Republican leader, Sen. Mitch McConnell of Kentucky. McConnell said his strategy was standard business for the Senate: "Either to shape things that we thought were headed in the right direction and there was a possibility of meeting in the middle, or if we thought it was completely inappropriate for the country, to stop it altogether."

    Like all strategies, the one Democrats have chosen is a gamble. Voters tell pollsters they are more likely to vote for Democrats than Republicans next year. But will voters stand by Reid if 2008 is branded as a do-nothing year?

    When Republicans called Democrats the do-nothing Congress this year, Democrats spat back that Republicans were the Grand Obstruction Party.

    Schumer, who heads Senate Democrats' reelection efforts, likes to say Republicans are filibustering themselves out of office.

    Democratic senators will fan out to their states in 2008 and say that Democrats stood together for initiatives popular with Americans - ending the war, providing health care for kids, curbing global warming.

    "People know what we believe in, what we stand for, they know the Republicans are blocking us and that's OK," Reid said.

    He believes his party will pick up at least four seats next year. If so, he would be in striking range of the 60 votes needed to pass legislation.

If we struck in the GC process though we have a strong profile (careerwise, w2wise, taxwise, educationwise etc), we need to face waves like recession wave, backlog/perm wave, merging wave, economy wave, I140premium/nopremium wave, bipart wave, 2001 eb3stuck wave, magic visa bulletin wave, technology wave, visa stamping wave, uscis reform wave, dol wave, bulletin wave..

    we've found that the more compelling arguments tend to be those related to US competitiveness. If I was to use the housing argument in a meeting, I would use it in a light hearted way while making a serious point. But it would certainly not be an issue that would be worth focusing on.

    You said it in post above -- e.g. competitive with European blue card.
    (The Blue Card is not like GC, however, comparing with UK and right to remain after a fixed 5 year period would be an argument more compelling than housing)

    Which are the most compelling arguments will also depend on the law maker's background. For some family issues are a factor, then housing can be brought into the mix with other issues like age out. However, law makers with which the family issues hold greater sway also are more likely to hold us hostage for CIR and relief for the undocumented.

    For most, common sense of justice is an issue, in which case housing can be brought up, but again, not an issue to focus on too much, more in the context of 'it is ironic that many of us want to buy houses but GC wait is what prohibits that, not the credit crunch'. Can be mentioned in passing, but not worth focusing on.
