Check with the prevailing wage for your new location that matches your job title/description. It needs to be close to that.
The salary needs to be 'at' or 'above' the prevailing wage, not 'close' :)

Hi!
My H1B was filed on April 1st 2007 at Vermont Service Center while i was in India and got selected in the lottery. I came to US on May 13th on H4 visa (I 94 valid till July 18, 2008) and still my papers were under process.
On June 1st, 2007 the approval notice was sent to my employer.
Oct 1st, 2007 they applied for my change of status and on 19th it was returned back as a check for 500$ was not included.
Kindly let me know if we could go for a H1B Transfer and change of status simultaneously with a new employer.
Within what time line i need to apply for the same.

Hi All,
I applied for Labor in EB2 category in Oct 2007. It was pending for 2 yrs and 2 days back my employer mentioned that they see my Labor status as denied and that they have not received any denial letter yet.
My H1 will expire in early Jan 2011, so I practically have around 365 days from now to apply for a new Labor. My questions are
1. Should I re-appeal?
2. Do Labors get approved in re-appeal?
3. Can I start a new Labor application with the same employer simultaneously?
4. What�s a safe category to apply at this point in time. EB2 or EB3?

IMO: 7th Year extn can be filed if PERM is pending for more than 365 days or if I-140 is approved.
You can also get 7th yr extension with approved labor. With approved I-140 you get 3 yrs of extension.

Thanks for the opinions, guys. Maybe I can try taking shots of the dining room after I finish painting it. It's at least more colorful than the stump.:D
