Did you ever had problem in getting VISA or your case was sent for further review because of security reasons? I just want to understand if there were any abnormalities in your any visa approval(s).

I would like to open this thread for those who are worried about the implications of using AC21 after 180 days. Lots of folks on several thread have either attempted to scare(any desi consultant ;) ) or are just scared!
I would like to have ppl share there reviews and experiences but I assure you
that AC21 is the law and your I-140 revocation has no effect to your on going process if you've done as required by the law as follows:
1. Joined the new job in the same or similar category
&
2. Minimum salary as specified per approved labour
So pls dont worry..be happy..love AC21! :D

Thanks for the quick and helpful reply. Just to clarify a bit more, can i still file for I-140 with her being primary(as cross chargibility is applied) while she is on F1 or wold it lead to conflict in visa status? SHe does not exits on my PERM application, but she is currently with me on H4, suggesting her intent to immigrate with my PERM application

I came back on Sunday after landing with a expired visa but valid H1B till 2010
My family had valid visa till sept 07
So we donot need a valid stamped visa to come back. ? We can come back if we have H1 papers.Thanks for the respose.

I am trying to fill the canadian visa application and would like to know what should I check on Question #8
a) citizen( obviously not)
b) Permanent residet
c) Temporary resident
d)Worker
e) Student(obviously not)
It also asks valid until date(What should I put).I am no longer working on H1B as I am using EAD
Need to travel to canada on Friday(08/13/2010)

If the Labor mentioned as a job location in NY...after we get the EAD..we cant move to Florida and work there..?

I was referring to current job location BEFORE filing for I-485 application. A person can be out of H1 status if he/she is working on a location that is different from mentioned in the H1 LCA. This is something not many people are aware of.

So USCIS is still reviewing I-140 even at I-485 stage. That is scary if your I-485 is at different service center than your I-140 approval.

I filed for AOS on 07/2007, stopped using my current H1-B on 07/2008 (valid thru 07/2009). I am EB3-India PD 03/2005.
My question is if I can apply for a new H1-B thru a new company in the US now, instead of a transfer? I have a valid reason for doing that. Do let me know.

yes you can. Since your PD indicates your LC is >365 days old.

Our demand should be reasonable.. The law makers knows what kind of people they want. One may have MBA or MA, and they may feel their degree is valuable to America. However it is up to the lawmakers to decide what they want.
One guy was asking whether social science considered as science as it is having science. I am not undermining any degree or any branch. We have to appricate atleast they are excempting STEM from numarical count.

What america need at this moment is innovation, research, new technology, alternate energy to overcome growing energy crisis, environmental care health care, nanotechnology, any advanced research to keep america in leading edge. Thats why lawmakers are talking about STEM.

leave here..Any organization needs money to survive...Who
will donate it? But I agree that we need an organization
to represent ourselves.
Certain things we could address after GC Retrogression is
undercontrol ( if ever happens)
1. Address FBI name check issue..
2. Bring back VISA revalidation inside USA so that we
dont have to make a trip to US embassy..
3. Work for getting Social Security money back if we returns to home country.
....etc etc........
As time pass by old issues may be solved, but new issues will
surface.....
So I'll support an organization for sure!

I want to address this to everyone. Any organization needs a clear and precise Vision statement. Majority of the senior member complain that the people with green card and citizenship do not support immigration voice; then the question becomes what is our vision. If we confine ourselves to the benefit that we all should get green card, then what is the need for someone who has already got a green card to visit this web site. Humans are need based animals, whether you like it or not tomorrow if I get my Green Card (A big IF) it is very much likely that my visit to this website will be minimized. My priorities will be different. So core group should get a better vision statement which might address all immigrants.
The reason I came to immigration voice is slightly different, because I am still not convinced enough to accept that core group could do something which will make our law makers� act different. I support immigration voice on a bigger picture, it unites all immigrants together, and the website provides me support to all my immigration need. For example, I can search the website and find information regarding visa stamping, H1 quota and what my fellow countrymen think about it. So my sincere advice to the core group is to create a vision statement which is much bigger than the green card issue and which will make sure all immigrant no matter with green card or not will visit our website. Make the vision statement visible in the website. You have much better exposure through this. I have to agree, I am writing this out of frustration :D , but to be honest, do not treat this website for green card retrogression alone, treat it as something bigger, which will address all immigrant needs.

I'm in CA and my I-140 was approved by TSC (E-filing) and I-485 is pending at TSC (was filed at NSC initially).
here are my questions, I need help on...
1. If I file EAD now, where should I file?? TSC or NSC?
2. If its NSC (since I'm live in CA), will this filing trigger transfer of case from TSC to NSC??
